Fen-Phen Claims Update

This information pertains to claims filed in the Nationwide Class Action Settlement being administered through the United States District Court for the Eastern District of Pennsylvania.
CATEGORY I CLAIMANTS
Judge Harvey Bartle granted trial court approval to the 7th Amendment on March 15, 2005. However, several claimants and their attorneys filed appeals on April 11, 2005, objecting to the terms of the 7th Amendment. This means that final approval of the 7th Amendment cannot occur until the appeals are concluded.
Fortunately, however, the entering and processing of the 7th Amendment claims has not been stopped, which means we can still forward our clients’ information to be processed, and hopefully by the time the appeals are resolved, the first distribution of payments can be made soon thereafter. Unfortunately, we do not have a projected date because we don’t know when the appeals will be concluded. How long it takes to receive payment will depend on how long it takes for the 7th Amendment to receive final judicial approval, and how long it takes to complete processing of claims. However, we anticipate some claims may be paid in early 2006.
The claims process involves electronically uploading your information onto a database set up by the Fund Administrator, and includes a Declaration form to be signed by each claimant. You should be receiving your form shortly. Please sign it and return it to us immediately.
